STEP BY STEP GUIDE TO PROPERTY SELLING
For most people, buying or selling their home is the biggest financial transaction
they ever get involved in. It invariably happens at a time when there are numerous
other things to worry about - a new job, moving to a new town or area, getting
married (or divorced), getting the children settled in new schools, and so on.
So naturally you want your house sale and / or purchase to proceed as smoothly
as possible. This is where your solicitor comes in! A good professional service
is not only about the quality of legal advice. It also means prompt attention
to your business, availability when you want to discuss something and communication
- keeping you informed about all developments.
Step 1 - DECIDE TO SELL & PREPARE YOUR HOME
Once the decision is taken to sell, we suggest you spend a couple of weekends
getting your property in tiptop condition. You may not add a huge amount to the
value of your home, but it can certainly increase the speed of the sale and may
sway the decision of any wavering buyers. See our 'Checklist for Sellers' for

Step 2 - PROPERTY GOES ON THE MARKET
Instruct your solicitor. Particulars and photographs are taken at your property
and a minimum sale price is set on the property, inviting offers over this price.
Once these have been approved, your property is placed on the market in the Aberdeen
Solicitors Property Centre and our marketing department begins to promote your
property.
Step 3 - VIEWINGS, NOTES OF INTEREST & OFFERS ARE INVITED
Anybody who views your property who then decides they would like to make an offer,
usually instructs their solicitor to arrange a survey of your property and to
note interest on their behalf. Once someone has 'noted interest' in your property,
we must allow that person the opportunity to make a bid before accepting an offer
from another potential buyer.
Step 4 - CLOSING DATE
In some cases, only one potential buyer will be found for your property. If so,
your solicitor will try to negotiate the best selling price for you. However,
if there are two or more potential purchasers, a closing date will be fixed and
all interested parties will submit their best offers and proposed entry date.
Offers that are received at a closing date can be accepted or rejected but normally
the highest offer would be accepted.
Step 5 - MISSIVES (missives are another word for the contract)
Once you have accepted an offer, the seller's and buyer's solicitors, acting
as agents, exchange letters and iron out any of the finer details that were not
mentioned in the original offer. This may include such things as details of any
fixtures and fittings that are actually remaining at your property, or perhaps
a slight alteration to the entry date.
Step 6 - CONCLUSION OF MISSIVES
When both parties have agreed on all of the details of the offer and set a formal
entry date, the missives are concluded. This means that both parties have now
entered into a legally binding contract from which withdrawal will undoubtedly
incur financial penalties.
Step 7 - CONVEYANCING
Your solicitor will obtain your title deeds, request all the updated searches
required. These enquiries deal with various aspects, the title and local authority
matters affecting the property in order to comply with the conditions of the
contract. A statement would be requested from your current lender asking for
a redemption figure to be sent with the amount to pay off your mortgage. In most
cases, your solicitor will also act for your lender in preparing the discharge
- the deed by which the lender releases the property from its mortgage security.
Step 8 - SETTLEMENT
Before the entry date, your solicitor will release the title deeds to the buyer's
solicitor for scrutiny. On the date of your entry, your solicitor will expect
to receive the purchaser's solicitor's cheque for the sale price of your property
and in exchange, deliver a set of your keys to the property and the disposition
and any other title documentation to the buyer's solicitor. The disposition is
a document that legally transfers the property to the new owner. Your mortgage
will now be redeemed and you will be sent full financial details of the transaction.
Step 9 - ENTRY DATE
- It's time to move out (if you haven't already !)
- Lock the door and post your keys through the letterbox !
- The Sale is now complete !
